When you are ready to legally end your marriage, the process in Ontario generally follows one of two paths. Choosing the right one depends on how much you and your spouse agree on the details.
1. Simple vs. Joint Divorce: What’s the Difference?
Both of these are considered "uncontested" because no one is fighting the divorce itself. To qualify, you must have been separated for at least one year.

Simple Divorce (Sole Application): You start the process on your own. You file the paperwork, and your spouse is "served" with the papers. If they don't file a response within 30 days, the divorce proceeds based on your application alone.

Joint Divorce: You and your spouse file for divorce together as co-applicants. This is often the smoothest path because it shows the court you are both in full agreement. There is no need for formal "service," which can save time and reduce stress.
2. When a Divorce Becomes "Contested"
A divorce is contested if your spouse disagrees with the divorce itself or—more commonly—if there are unresolved issues over:
